Common Questions
The process of successfully winning a SSDI claim can be an involved and time consuming process. If you have already filed for assistance and need to file a reconsideration request, is highly recommended that you find a Social Security Disability Lawyer. Seff Capizzi Law Group has been practicing Social Security Disability Law for over 35 years. Contact us so we can help you successfully file.
The Social Security Disability Insurance program distributes benefits for those who qualify, through one of two options: Supplemental Security Income (SSI) and Social Security Disability (SSD).
The SSI program pays benefits to disabled adults and children who show limited income and have not made a satisfactory contribution to meet the requirements for SSI. SSI recipients typically qualify for Medicaid.
The SSD program pays out benefits to individuals and certain family members who have worked the required number of years, and have paid social security tax. The Social Security Administration will assess the amount you get based on your contributions. SSD recipients qualify for medicare. Contact us for assistance with your SSD case.
To qualify for benefits, the Social Security Administration uses a prescribed process to determine if you are disabled. This is a step by step system, in which you must meet a number of qualifications. If your impairment is a “listed impairment” you will be filed as eligible to receive SSD. If you do not have one of the “listed impairments” you can still qualify, but there is an additional process the Social Security Administration will go through to determine your eligibility based on education, age, income status and other factors.
If your attempt to file is denied, you will have 60 days to file an appeal. Contact us so we can help you successfully file your appeal.

Before you start the process of applying for Social Security Disability, you have to be able to prove you will be unable to work for at least a year due to a permanent disability. In order to do this, you should start by gathering official documents such as medical papers, doctor’s notes, official identification documents like birth certificates, tax forms, and naturalization papers. Contact us for assistance with details about this part of the process.
If you are in your 20’s or 30’s, winning a claim is impossible.
This is simply not true. If you meet the eligibility requirements, you are able to win a claim regardless of your age. It is not harder to win a case because you are not “old”.
Having certain diseases automatically get you benefits.
Not true. Although some diseases are weighed as more likely to qualify you, it doesn’t mean that you will get automatic approval for benefits.
Everyone gets denied the first time they apply for Social Security Disability.
A lot of cases get denied simply because the information they have provided the SSA was not sufficient. Having a Social Security Lawyer will help you organize and coordinate paperwork from you and your healthcare provider, making it easier to avoid first time mistakes. Not everyone gets denied the first time they apply.
